A legal disclaimer

AS Bike Rental Company, Shimla

 

By renting a bike from AS Bike Rental Company, you (“Customer” or “Renter”) agree to the following terms and conditions:

 

1. Eligibility

  • Renter must be at least 18 years of age.

  • A valid government-issued driving license (two-wheeler) must be presented at the time of rental.

  • The renter must provide valid ID proof (Aadhar card, Passport, Voter ID, etc.).

 

2. Rental Period

  • Rental is calculated on a 24-hour basis unless otherwise specified.

  • Late returns will incur additional charges as per the hourly/daily rate.

  • Early return does not qualify for a refund unless pre-approved.

 

3. Rental Charges and Deposit

  • The rental fee must be paid in full before taking the vehicle.

  • A refundable security deposit [₹___] is required. It will be refunded upon safe return of the bike in the same condition.

  • Damages, traffic fines, or late fees will be deducted from the deposit.

 

4. Vehicle Condition and Usage

  • The bike will be provided in good working condition. A joint inspection will be conducted before handover.

  • The renter is responsible for returning the bike in the same condition.

  • Bikes must not be used for:

    • Racing or stunt riding.

    • Towing other vehicles.

    • Riding under the influence of alcohol/drugs.

    • Illegal or off-road activity unless specified.

 

5. Fuel Policy

  • Fuel is not included in the rental. The renter is responsible for refueling.

  • The bike must be returned with approximately the same fuel level as at the start.

 

6. Accidents and Damage

  • In case of an accident, the renter must:

    • Immediately inform AS Bike Rental Company.

    • File a police report if required.

    • Bear the cost of damages not covered by insurance.

  • Any unauthorized repairs are not permitted.

 

7. Breakdowns and Assistance

  • In case of a mechanical failure, contact AS Bike Rental’s support at [Phone Number].

  • Minor repairs may be reimbursed if prior approval is taken.

 

8. Insurance

  • Bikes may carry third-party insurance only, unless otherwise stated.

  • The renter is liable for any personal injury, theft, or loss not covered by insurance.

 

9. Cancellation and Refunds

  • Cancellation within 24 hours of rental start time may incur a charge.

  • No refunds will be made for:

    • Early return of the bike.

    • Booking cancellation at the last minute (unless due to emergencies, at the company’s discretion).

 

10. Limitation of Liability

AS Bike Rental is not responsible for any:

  • Personal injuries, loss of belongings, or death during the rental.

  • Consequences of misuse of the vehicle by the renter.

 

11. Governing Law

These terms shall be governed by and construed in accordance with the laws of Himachal Pradesh, India.

 

12. Agreement

By signing the rental agreement or making payment, the customer confirms they have read, understood, and agreed to these terms and conditions.
